The Research and Studies section includes topics on electronic arbitration agreements under Qatari law, environmental protection during armed conflicts, electronic consent in Qatari law, suspension of criminal proceedings in Sudanese law in comparison with Qatari law, and the legal validity of modern electronic contract applications under Qatari electronic commerce law.
The issue also includes studies in the commentary section, selected judgments of the Court of Cassation, and legal opinions relating to allowances and employment benefits.
Arbitration is the parties’ agreement to present their existing dispute, or which may arise in the future, before certain persons called arbitrators. The parties prefer to resort to arbitration due to its confidentiality and the speed of taking its procedures. The electronic arbitration agreement is concluded over the Internet, as it is assumed that the parties are not physically present in one place. And the electronic arbitration agreement, like any contract, must be satisfied by the pillars of the contract of satisfaction, place and reason. In addition, the arbitration agreement is a formal agreement in Qatari and Egyptian law, so it must be in writing.
And the electronic arbitration agreement, like any contract, must be satisfied by the pillars of the contract of satisfaction, place and reason. In addition, the arbitration agreement is a formal agreement in Qatari and Egyptian law, so it must be in writing. And the judiciary, and after him the various legislations in Qatar and Egypt, considered electronic writing as paper writing.
The protection of the environment is in fact an important topic in public international law. A myriad of international agreements and instruments were issued, and a special regime of responsibility was established with the aim of protecting the environment from the various harmful effects that might be inflicted on it, i.e. the regime of objective responsibility. As a result, a separate branch of international law deals with matters related to the environment due to the surrounding intricate issues that require the adoption of special rules.
In recent years, the need to adopt rules to protect the environment in times of armed conflict has emerged, given the practices adopted by some countries during armed conflicts by targeting the environment or making modifications thereto to achieve a military advantage. This was evident during the Vietnam War (1962–1971), which led to the adoption of the 1976 ENMOD Convention and the First Additional Protocol to the Geneva Conventions (1977), prohibiting methods of warfare expected to cause severe, widespread, and long-term environmental damage.
However, these instruments did not prevent serious environmental violations during armed conflicts, including the burning of oil wells during the Gulf War in 1990 and the indiscriminate targeting of civilian areas and objects during the Lebanon War of 2006.
Therefore, this research evaluates the effectiveness of current international legal mechanisms in protecting the environment during armed conflicts and concludes that there is a pressing need for a comprehensive international convention specifically dedicated to environmental protection in times of armed conflict.
Modern telecommunication technology has significantly transformed traditional methods of expressing consent in contract law. Society has shifted from paper-based communication to digital interaction, allowing offers and acceptances to be exchanged rapidly through connected digital networks.
This technological evolution has challenged classical legal doctrines governing contract formation, including offer, acceptance, consent, and consumer protection. Traditional legal principles often appear insufficient to address the realities of electronic transactions.
The study focuses on the legal issues surrounding electronic consent in contracts formed through modern communication technologies. It examines whether traditional rules governing consent remain applicable in electronic environments and analyzes the extent to which Qatari legislation—particularly Law No. 16 of 2010 on Electronic Commerce and Transactions—provides an adequate legal framework for such contracts.
The research concludes that Qatari law generally recognizes electronic expressions of will and permits contract formation through electronic means, while emphasizing the need to address challenges related to identity verification, legal capacity, and defects of consent in digital environments.
Sudan’s Criminal Procedures Code and Qatar’s Criminal Procedure Code grant the Public Prosecution authority in certain circumstances to discontinue criminal proceedings by notifying the court that it does not wish to continue the indictment or prosecution, even without stating the reasons for doing so.
This authority raises questions regarding the separation of powers and judicial independence, since it permits the termination of criminal proceedings after they have begun. The study examines the legal basis, justification, and implications of granting such authority to the Public Prosecutor, and analyzes whether it remains necessary under contemporary criminal justice systems.
The research concludes that staying criminal proceedings constitutes a judicial decision by nature and may conflict with constitutional principles safeguarding judicial independence. It recommends subjecting this authority to judicial oversight and limiting its use to exceptional circumstances of absolute necessity.
Electronic contracts have become an essential method for conducting commercial transactions due to the expansion of Internet usage and the emergence of technologies such as cloud computing, automated systems, Bitcoin, and Apple Pay. These technologies facilitate the rapid and efficient conclusion of commercial agreements, often without direct human intervention.
Despite their advantages, electronic contracts raise important legal questions concerning their validity, the place and time of contract formation, applicable law, and evidentiary value. Existing international and domestic legal frameworks do not provide comprehensive substantive rules governing all forms of emerging electronic contracting technologies.
This study examines the legal validity of electronic contracts under Qatar Electronic Commerce and Transactions Law No. 16 of 2010, together with relevant international instruments including the UNCITRAL Model Laws, the United Nations Convention on the Use of Electronic Communications in International Contracts, and the European E-Commerce Directive. It concludes that legislative development is required to address uncertainties created by emerging technologies and recommends that the Qatari legislator specify the exact moment of electronic contract formation and develop non-traditional legal approaches suitable for new technological environments.
