The Legal & Judicial Journal
A new issue of The Legal & Judicial Journal continues its approach of developing and encouraging legal scientific research in vital fields associated with legal and practical developments witnessed by the international community, the Arab community in general, and the Qatari community in particular.
This issue represents a transitional phase through which the Legal and Judicial Studies Center seeks to develop the content of the journal in line with Qatar National Vision 2030 and its status as a distinguished peer-reviewed legal journal.
The issue includes studies on preventive and punitive measures to secure sporting events against stadium violence, particularly in relation to FIFA Qatar 2022, procedural regulation before the newly established Investment and Trade Court in Qatar, commentary on spouses’ rights in Qatari law, and a selection of Court of Cassation judgments and legal opinions.
This study examines the procedural organization of litigation before the Qatari Investment and Trade Court, compared to the Egyptian economic courts, through a comparative analytical approach, during which we dealt with the formation of the court and its jurisdiction, then the electronic litigation procedures before it, then the rulings issued and the methods of appealing and implementing them.
This study showed the importance of these courts in attracting investment and achieving development goals, through what they are based on complete justice, in these disputes that are based on speed, credit and trust, and that require special judicial expertise, facilitated procedures, and short deadlines for adjudication.
Securing sporting events against Hooliganism has become one of the major challenges to all states. To fulfill their responsibilities, states, in facing such a challenge, have enacted special laws that rely primarily on two different kinds of legal provisions, the first of which are of a preventive nature and aim to preclude any potential disruption to the public order during sporting events. The second kind of legal provisions are of a punitive nature and consist of legislative provisions that criminalize all sort of violence with relevance to sports events and deter their perpetrators.
The Qatari legislature however has not adopted a similar legal regime to combat hooliganism and opted instead to tackle this phenomenon with the already existing legal provisions in criminal and administrative law.
Therefore, this paper seeks to study and evaluate the Qatari legal regime on securing sporting events, in the light of comparative law experiences, especially the French experience.
In the State of Qatar, Law No. 21 of 2021 related to the establishment of the Investment and Trade Court was issued. The aim of this law was to found legal rules that meet the aspirations of both national and foreign investors. Through this law, the Qatari legislator was keen to advance the performance of the judiciary in the fields of finance and business. This is hopped to be achieved by means of facilitating procedures in commercial law cases that require speedy settlement, and by the presence of judges specialized in investment and trade disputes.
It is noted that this law expanded the jurisdiction of the court it has established to include a wide range of trade and investment issues. However, this expansion of the jurisdiction of mentioned court generated problems at the level of the case value and subject matter jurisdictions that court. In addition, it produced another problem related to the distribution of jurisdiction among the circuits. It also created problems at the level of the terminology used, which affects the rules of jurisdiction.
Therefore, this research addresses these issues through analysis and comparison with other legal systems.
